Doubt it. One of my favorite things about this case is that it's a female judge. The easily predicted bias would be in favor of women in general, not attractive ones. But the judge's quotes are very specific about the nature of the act and the lack of awareness of the defendant. This is law done fairly and properly. I think based on this judge's statements, it's a solid guess that she would have responded this way to any defendant who committed the same acts under the same circumstances.

I support the general voicing of this possibility in theory, but her concern about betrayal just suggests way too much personal insecurity for that. To be fair, legal language saying "sexual intercourse without consent" way predates the misuse of the word "rape" we see today. The nature of legal language is to use very precise unambiguous terms that are specific to exact actions taking place, at their most broken-down-and-explained level. I agree that we should try to maintain standards and criticize people co-opting the word, but the fact remains that it's the laypeople word for the act and has never really been precise legal language.

This isn't true of every jurisdiction. It's true of a lot of the USA (and actually using an implement to penetrate is part of it, doesn't have to be a penis) but there are places where sexual assault laws are more gender-neutral, and Montana is one of them. It's more concerning to me that they were hesitant to label her with the charge, which I can only guess is a product of general hesitancy to treat women as actual sex offenders.

Not correct. Montana actually has gender-neutral sexual aggression laws, it's just that the legal term for the charge isn't "rape", it's "sex without consent". Which is more specific. We should be glad legal language is using precise phrases instead of highly inflammatory and overused words. Like, yes, I agree she raped him but in this day and age people use "rape" to mean a lot of dumb shit, so it's important that legal language not be that vague.

Because the actual name of the charge is probably more specific than the word "rape". Calling charges what they are isn't using euphemisms, it's being journalistically precise. Given that there's a widespread problem of people overusing the word "rape" for lesser crimes and casually diluting the meaning of the word, it's a GOOD thing that the press is sticking to specific legal language.

We do, it's called abortion because it's aborting something. And it's not a baby for a while yet after it starts growing. The thing doesn't even start forming a useful nervous system and the ability to perceive harm until around 16 weeks. Before that point, it's only just barely technically accurate to even consider it an organism, it's much more like a highly organized tumor. This is the reason I still enjoy 4chan. There's a lot of trash to sift through, but what's gold is gold, and you get a kind of frankness and clarity that doesn't typically get provoked in other environments.

Heh, thanks. And I didn't even know that. Most of the people I hang out with from the engineering school here are MEs, EEs, and the occasional chemE or mining guy, and it seems like most of the PETEs are from other countries.

Tell that to all the law school grads, teaching school grads, and even (increasingly, slowly) engineering grads who are busing tables because they can't get a job either. I know plenty who will cheerfully tell you to fuck off. Making fun of art majors has its place but reasoned discourse based in reality isn't really it.

A statement becomes bullshit when it isn't given proper context. Saying "Women make less than men" without giving context and clarification about what variables are controlled for is like saying "Water is ice" without specifying at what temperature and pressure.
