Here in OK, the child support calculations assume both parents can and will work. If either parent is currently out of work, the calculator uses the assumed earning potential. Likewise, your income should be based on realistic earnings and hours. Using the earnings for 70+ hours is a bad idea unless this is normal and reasonable for you.

Her extra income is called imputed income. If you can prove that the income is consistently coming in, then it can be included as part of her whole income stream.

Thanks. We've agreed to stay here. She's looking for a permanent home to buy. I could never be that far from my kids so I would have been forced to move with them.
