I do need to see an attorney. The problem is that in Virginia there are no settlements of arrearage with the exception of interest if the mother foregoes the interest in writing to the court. When I mean no forgiveness of arrears I mean none, according to most attorneys I've spoken to (about three so far contacted through Avvo directly).

Thanks. The problem in Virginia is that DCSE deducts 55 percent of your net income as long as you are in arrears. If you have a high monthly obligation essentially (if you’re in a horrid sweet-spot like me) you have very little income to support yourself and pay your obligation. Assume I’m making $65k a year, I’m making like 40 something after tax I guess. Then I’m left with $1500 net a month to live off of give or take. It’s a tragedy. I can go nowhere. 5 years of marriage three-four years cohabitating, Virginia, alimony - until I change it (it’s been 5 years since assessed), $450 alimony, $1000 child support, no idea how much she makes. Probably less than $20k.

Bud, I had a summer of nervous breakdowns (manic bipolar episodes they're called these days) over this. All the while I was accruing over $1450 a month in child support and alimony in addition to my arrears and interest over six months. Now I literally work/sleep/eat, and now live with family to send all my money to my ex except for bills and some beer money once every couple weeks. Good question. State department put a hold on the renewal of my passport until my arrears are paid off. I believe it can be federally enforced that way, arrearage. Once it's paid in full I get a new passport. Plus I would like to continue to have a relationship with my children.
