Ah, but those prisons are in Australia. There the point of prison is to rehabilitate prisoners to help make them functioning members of society. In the US, its more of a place to serve your time, and be influenced by the criminals that surround you.

Usually that phrase is used for people who are in pain and slowly dying, such as an animal with a fatal and very painful wound, or a person who is terminally ill and is in pain with no reason to live. Very rarely is it used to describe a prisoner on death row. This is more of a personal opinion, but I see the death sentence as a much more severe punishment. Personally, I don't believe there is such thing as the 'same crime'. Every crime is very different. Even if two people both stole something of the same value, they could get very different sentences depending on what happened. One sentence may be longer than another, but the judge chooses what they see fit. Our justice system is far from perfect, but for most people it provides fair punishments.
