My only comment is my father and mother in law divorced 20 years before I met my now wife. They had something similar he kept the house as it was on what was family land and she moved in with her AP now husband. Similar to you just reversed my FIL kept the house and was going to buy her put later. Its now been about 40 years since the divorce and he is retired and my MIL has never seen a dime.

Might be worth finding all the good divorce lawyers in your area and setting up a consultation with them to block your stbx from using them.

I foresee another separation and divorce in your future. Your wife wants to be able to live without you until she needs you or you are able to move past her than wants to scorch your life. Time to bite the bullet and get it over with.

Oh man, I'd be in jail for contempt. If I have to provide transportation for her convenience then she could pay for said convenience. 2 hours a day for a car service.

Agreed, who knows might just end up being a new friend.

Till the ring went on the finger. To the op it's amazing how similar our stories are.

Nothing says equality like a woman going through divorce upping her income by taking yours. We have 3 kids and she wanted me to keep our 4 bedroom house pay her half the equity and then said we would do 50/50 custody in her 2 bedroom apartment knowing she planned to dump them on me but wanted that child support.

Similar to you my wife spends her money on her, she pays her car payment and groceries every other week. I pick up every other bill somehow. She filed for divorce and what almost put me in prison is yes I make twice what she does and besides half of everything I've saved while she spent all her money is she wanted spousal support to get closer to parity on income while asking for child support. The mediator who was clearly on her side told me even though we would do 50/50 custody I would be payi…

Why would child support increase if she remarries?

Wife was a "Christian" and repeatedly cheated on me. Now after 19 years she wants out. What's frustrating is even though she no longer wants me, she wants the fruit of my labor for the next 6 years till my youngest ages out of child support. This on top of half the assets I scrimped and sacrificed for as she spent her income on herself.

When is her green card up for renewal again? Or does she have her citizenship now? What happens if you refuse to sponsor her again?

My "wife" has decided after cheating she no longer wants to be with me. It would be great if that's what she wanted, but what she wants is me gone but my money to stay.

OP, my STBX did cheat wants a divorce but like your wife wants her cake and to eat it too seems to think if she runs into trouble that I should help her out. Initially she wanted me to keep the house so the kids would have a stable home and they would visit her. I was thinks great she just wants her freedom I won't ask for child support. Now she still wants to move out but thinks she should get alimony, child support and have me help her out as she is a spender and will run through any amount I …

How is it that she moves two hours away and all the travel is on you. One might think she should have to bring them to you. But I would think fairness would have the exchange 1 hour from each of you. A 4 hour round trip on a Friday night after work seems dangerous.

Why have family court. Sounds like it can be selectively worthless and toothless.

Seems only she benefits from the appraisal as she wants to use it to siphon funds from you. Not a lawyer but my response would be, NO.

Should also be filed with his county registry of deeds.

If she can't waive alimony in the pre-nup and you are at risk of all your assets for alimony. Does it not make sense to offer something you can live with in alimony in the pre-nup? Think what you will lose with lawyers fees and time if you end up fighting this anyway down the road.

Heck really doesn't matter if it's 50% or 30% of marriages end in divorce, the rest end in death so there is no good ending to marriage 😂

I would move out and have a realtor put the house on the market next day. She doesn't like it tough

I read that as "We divided everything 50/50 including kids" and was like..you savage didn't catch the "time" part at first. 😅😆😆

Another thought on the 40k, sounds like if you go after it that your in for a fight, what is that going to cost you in lengthing the divorce process and additional legal bills to your attorney. My only concern for you is her turning around after this is a done deal and coming after you for more child support.

I prefer the wack her over the head with said shovel, less chance she can get back up. 😁

The she lost her job so you need to pay more just hits so wrong, the cost to raise the child has NOT changed. If she can't afford to support her child because she doesn't have a job, maybe she shouldn't have 50 percent custody so you don't have to pay more and it allows her more time to find a job.

She owed you fidelity, you didn't get that your likely not going to fet the closure you want.

Tell her what you just told us. There is no telling if she gives you another chance but you would be a fool not to let her know you realize you screwed up and miss them and would like to try and fix it.

Here's my rant, take half your pay so she maintains her lifestyle but your lifestyle is not maintained..She should have to work or lose 40k if maintenance per year average wage.

If she moved, why is the onus on you to travel to her, she should travel to you as she made the decision to take off with the kids.

With online banking and the ability to transfer money, I can see a wife with intimate knowledge of husband and access to say his phone for a period of time like a hospital stay could get herself into his accounts and transfer funds out.

Not a lawyer, but how is his payment on the house she is living in not considered spousal support? I realize since the loan is in his name he can't just pay her spousal and say pay the mortgagr because if she doesn't pay it ruins his credit.

First Marriage and divorce wasn't that bad, we split most assets and debts, no kids and she worked. Was awhile before I considered marriage again now 17 years in...

Not only that but if OP cleans up his debt, that's half her debt as well and who is to say she doesn't come after all his stuff.

I stay with a family member twice a month not because I have to but so I don't cohabitate for 90 consecutive days then go right back to cohabitation with the same man. What a terrible law. One might also saw she met the letter of the law but not the intent.

You have no idea, she didn't even have taxes withheld from her paycheck last year. That was a surprise at tax time. She spends everything she earns plus most of my income. Never again will I get married.

Makes you want to say F it and stop paying, and when the judge says contempt you respond with no where near the contempt I hold in my heart to all of you....as your dragged off to jail you wake up from this Nightmare and keep paying...

She won't care if you lose your job, just imagine what living hell she will make your life if you miss a child support payment.

Why is the norm the father becomes almost a reservist (1 weekend a month 2 weeks a year) type in his own kids lives. And even if it's not in the calculations and it's what the mother wants, how long before she turns it into another issue, like I have them all week and every other weekend and you get to do whatever you want with your life type thing.

Never been in your position. Its possible they didn't have the strength to look you in the eye and tell you. They are still your children and may someday understand what they did to you. I wouldn't just leave them to thier mom. But that's just my opinion I've never been where you are.
