Ontario Canada for example, our caselaw indicates that victims are given more credibility and that the tort of sexual battery non consent is presumed meaning you have to put forward evidence as a defendant or you're presumed to be a rapist (civilly speaking). I have the child when school is done. Ive been advised by the sergeant that she (female cop) will personally attend and speak with my son's mom at her residence. I've been advised the police spoke with my son's school and they are not to release my son to my ex. This is happening pretty quickly so things are a bit messy atm. In the meantime I still have to provide the mother access as per the agreement but we are moving for supervised access to prevent issues.

I have obtained a lawyer, I am heading in to check my son's school if he's there, if he is then I am going to the police department and filing a formal complaint. Well it's a criminal code offence to withhold access in Canada, for a non-custodial parent it has it's own special section. The police didn't enforce the law, that is their job. I will be making a complaint to the OIPRD ( Police Review Director), and filing for an under S 36 which is a direction from the court to enforce, and will be clearly laid out, and subsequently sue the local pd for costs. (I do this for a living, although I don't touch family)

Most did not lead to criminal charges. I don't work in American law but I imagine those civil cases are not met with limitations under us civil procedure otherwise I couldn't see why a judge would rule on them barring reasonable excuse for not bringing about the action. For example in Canada we have no statute on criminal law, and various limitations on civil cases ie generally small claims is two years after discovery.

Well she for custody, if she can't take care of the child which she's saying she can't, and you can then great. Yes, but that's basically like getting a warrant for a pat test. It's a way to create a barrier to prevent fathers from knowing if they actually fathered their children. Maybe there's a doubt and that false or positive paternity test is needed to either put the mind at ease, or to make the decision and say "Okay, not my child, wife cheated on me, time to take this to court".
