Car crashes are very rare on a per mile driven basis, even fewer are life threatening rather than fender benders, but you still put your seatbelt on every time you get in the car and the government makes installing them mandatory. Just because you think seatbelts are stupid, doesn’t mean people using them is. Sorry but that word deluge is misinformed. If you have a written agreement the critiera I listed doesn't matter. The "prenup" like agreement stands. Absent that - implied agreements are proved using the criteria I listed. It's that simple. You obviously don't know what your talking about and I have work to do so I hope you never have to find out how wrong you are.

When deciding if you have a claim they look at all of those criteria plus more. Those are just the most common and easiest to prove. The length part I put in is crucial because it establishes a long term stable established relationship. This isn't about getting a specific property item. It's about establishing a relationship unit - which would then qualify you for similar rights as a divorcing couple.

Except the criteria I listed isn't from states that have codified common law marriage laws. The requirements I listed are the ones used in states that do not have these laws. Okay buddy. For everyone else who don't have their head in the sand and a thumb up thier ass, protect yourself. If you answer yes to these you can get fucked over: Did both parties pay bills regardless of who's name they where in? Did you buy things using both parties money? Did both individuals live/use property even if only one was on the title? Did you have a stable relationship where you live together at least part time. Length of cohabitation, 10 years+? You're screwed by default usually.

For the most part yes it is this simple. It varies by state but almost all extend similar rights as divorcing couples during a split if a party fights for it.
