A significant proportion of problems in today's society can be attributed to kids being raised outside of marriage. Kids are barely better off with cohabiting non-married parents than they are with single parents. If you want to have kids (I get why some people don't want to, but for me, I consider it my purpose in life), then do the right thing by them and get married.

Well, it's not like I can't get my wife's consent -- she's totally on board. I just dislike the fact that they're requiring it. Abortion clinics do not require paternal consent, and laws attempting to force them to have been struck down as unconstitutional. A different situation here, as the law doesn't require them to get my wife's consent, but it still rubs me the wrong way.

Neither of those two cases apply here -- there's no statute requiring her consent, this is just some policy the doctors' office has. No government actor, so no constitutional violation. The HIPPA thing is intriguing; perhaps there is a private cause of action for trying to get around HIPPA? Obviously, this is not my area of practice.

Yeah, but that's kind of beside the point. I don't mind getting my wife's consent (it should be a joint decision), I mind the requirement that I get her consent. Plus, I shouldn't have to lie -- to my own doctor -- to get a procedure on my own body. I didn't have to sign anything when my wife went on birth control.

I'm probably not yet cynical enough about my own profession to believe that a lawyer would bring a facially frivolous case for such a small amount and risk sanctions. But you're probably right. What if it is alleged that the clinic mislead him about the permanent effects of a vasectomy? Well, I never said he wouldn't have a claim against the clinic. Obviously I would expect to have to sign a consent form (maybe dozens) for myself.

Yeah, I'm not doing that. However, according to google I'm not the only one who's had this problem (or even the first one to post about it here). From the first article: while there’s absolutely no law requiring men to obtain their partner’s consent, it can be imposed on a case-by-case basis at a clinical level. I guess I could post a scan of the consent form once I get it, but would that prevent claims that I created it myself?

Well, I am a lawyer in the US. I'd like to think there are some safeguards against completely frivolous lawsuits. Yes, it's expensive to defend, but there is a cost to bring suits as well, and a judge would not look too kindly on a suit brought with no tenable theory of liability. That said, I'm guessing you're right -- just easier for the office to require spousal consent rather than deal with angry wives, with or without a lawsuit.

That's my read as well -- that they're just trying to avoid potential issues with wives. That said, I don't see how there could be any issues, at least legal ones. A wife wanting to sue a doctor's office for performing a vasectomy on her husband would not find a lawyer willing to take the case.
