If they’re defending themselves then that’s the issue right there, if they have an attorney or a public defender then that would be a different story. As far as the separate charges, they’re separate crimes. It isn’t up to the citizen to decide he isn’t guilty and doesn’t have to appear before court, it’s for the legal system to decide through due process. 0	Entitled Woman is Trying To Resist Arrest Agreed, this situation was handled poorly, and America’s laws against otherwise responsible alcohol consumption (provided the person isn’t operating a vehicle) is ridiculous and to no benefit. As far as holding someone in a jail, the police may hold you for a limited amount of time, but you must either be charged with a crime or released and your attorney can request a judge orders your release if those conditions aren’t met. Then you have to track down the person who, depending on the severity of the infraction, may have fled and/or committed further crimes. Unless you’re describing a police officer giving someone a notice to appear before the court themselves under their own power, which is already how the system works for minor infractions and violations. And police don’t have unlimited powers, but obviously there can’t be exceptions to who has to obey the police and who doesn’t. The police officer isn’t there to determine guilt, the courts are. The police make sure that if you are suspected of breaking the law that you are brought before the court.
