| 1 | Can someone in the comments explain how this works?I'm believe you can give consent - and make the unwise decision to drive - while moderately drunk. However, if you're so drunk that you've passed out or can't speak properly, you can't give consent (and probably can't start a car). Rape also doesn't harm anyone other than the victim, whereas drunk driving can kill carloads of other road users.
