My STBx has an expensive painting that she claims is lost but I know it is in the apt she is living in that I don't have access to. Is there anyway to get a judge to issue a warrent to search her apt? The painting a marital asset and don't know how to prove she still has it.

I thought during a divorce you cannot "encumber" or take a loan on anything marital?

Thank you for responding and I am sorry for your pain...for some reason certain people are like this...they all seem to follow the same playbook for high conflict personalities that like to control and cause pain (wonder if it is from low self-esteem). Glad you are still able to get 50% of parenting time despite her shenanigans. It's terrible and emotionally draining.

Did she adhere to the motions you filed or ignored what the court said?

Yes...you are just at the start of the process...watch your money and where you spend on on attorneys as it gets expensive...

Just do your best...look at your credit card bills and checking accounts to help you out...if you do monthly direct payments from your checking account for your utilities, healthcare etc...you should have a good sense of that and if you lease a car your schedule b. For Schedule c, look at your credit card bills and checks paid to help you there. I would not spend too much money on this as you will need that money to spend later on. The overall amount you indicate on the cis shows what your marit…

Thank you so much for this advice and taking the time to write back (sorry it took me a bit to respond). To say your explanation was excellent is an understatement!. I truly did not understand the mediation process and how you did the financials but you explained it so well. I still don't know if I could go fast enough or when I get under pressure I don't think straight, so guess would have to say would need to think over if not sure. Thank you again and will let you know how it goes.

Last question...so you are saying know your bottom line and ask for more to have some room to negotiate. The only thing is the bottom line could change on things depending on what I get for others. I don't know how to calculate the numbers so fast during negotiation (even with a spreadsheet in front of me). So how do you manage this? I am concerned if I need time to think or have another session, spouse could renege on what they offered (if it was good for me) or I will ruin the momentum of the …

Thanks for the advice...very good...there really should be a course for people going through a divorce...the first thing everyone told me was trust your attorney...well that may be somewhat true but it should not be 100%...it's your life...and in reality they have their own agenda...where I live (and maybe where you live too) they are Officers of the Court and have an obligation to reach settlement...and also my attorney gets a lot of business from the court as she is also a mediator. We come to…

Great story about the cooler! Interesting how you said the lawyer told you to take the deal and you stood firm...I had that with my attorney at the beginning of the divorce. She said one thing and I slept on it and emailed her the next day saying I did not feel comfortable with that and it ended up going my way. I think I learn more on Reddit than I do from my attorney...real life information. I think I made mistakes with negotiation (we pretty much have been sending proposals back and forth). B…

That's what I am concerned about...the mediator will see me as the person who will compromise more to save attorney fees long-term. What do you suggest? Just staying firm on the things that are the most important? My attorney is constantly telling me to compromise but spouse never does. I am done!

You can kill a man, but you can't kill an idea.
