I know exactly how you feel, in fact I'm 55 so I'm worse off financially. Trust me later you'll be glad you didn't wait. If you're the primary bread winner, every day you wait is more you have to forfeit and the less time you have to make it up. My life would be so much better if I divorced at 45. You have to think about this as the better of 2 options (now or later....now is way better).

The formal agreement hasn't been drafted yet, but I agreed to pay for it out of my post separation earnings (incorrectly) thinking it would be highly subsidized. She's coming back from some health issues, so continuity of care is important. The divorce was finalized two days ago, so it's time to pay up. I saw it as a gesture to keep things civil. It's just a much bigger gesture than I thought. I don't like piece meal negotiations. Fortunately, it's the only thing I've agreed to.

They recently changed that. For divorces after x date, the paying spouse does not get a deduction, and the recipient does not show it as income. I assume that's because it increases tax revenues.

It's supposed to be the same level as my current employer sponsored plan. It's ridiculous because I assume Medicaid has lower out of pocket costs. However, rational thought left the station long ago.

I have to cover her health insurance for the first year. I'm trying to find the cheapest way to do that. It's hard to get doctors that take Medicaid (it's by far the lowest paying payor) and she has some health challanges.

A plan through the marketplace is cheaper. There's no tax benefit for COBRA payments, but if you purchase through the exchange, they discount the monthly payments as if you were paying them on a pre-tax basis. Therefore, the premiums are ~30% lower.

Here there are big consequences to doing that. It can reset your date of separation and restart the clock all over and bring in all of your post separation earnings until that date. It ain't worth it!!!

Definitely buy small stuff. They won't/can't really argue you're mishandling marital funds because you bought new speakers for your car or the really nice hair trimmer.

I say buy it, the truck in particular. It will depreciate right away. If you have 60 grand in the bank and split it 50-50, you give up 30 grand. If you spend 60 on the truck, it will only be worth 50, you're only out $25k and she takes half the hit. Watch out, her attorney might argue that the full amount of the truck comes out of your half. If so, you're in the same position as if you waited to buy it.

I don't think you can assign certain money to certain assets. Both marital property paid with marital money. You can argue that she paid that so you could pay the light bill, etc. etc. I paid 100% of the cost of the house, nobody gave a shit.

This is surprisingly helpful. I'm on the brink of telling my wife I want a divorce, but having a hard time deciding to pull the trigger. When he talked about the relief of being divorced, I actually felt it. Was an unexpected confirmation of what the right thing to do is.

I can tell you from experience, it doesn't get any better. Been in a dead marriage for years.
