If OP bought the original painting, then what happens to the copyright? Specifically, sales of reproductions of that painting? What happens if there was a sale of the original painting but no reproduction agreement was signed? Can OP put a copyright claim themselves (and actually register it) on the painting's image? Can OP go to eBay and tell them she has the copyright (and owns the physical painting) to stop sales of prints?

How about getting a child therapist to interview the child and video a "neutral and un-coerced" record for a possible court decision. Make sure the child knows they can tell you anything and everything. Have the child know they can trust you and you will listen and believe them.
