The legal proscription for it is of course, very clear. However, it stands also that rape was a crime justifying some pretty harsh violence in reprisal, even if it was to a non-Jewish outside tribe. The wiping out of an entire tribe is basically the most serious punishment one could proscribe. I'd say more than anything the law is there because everyone's first response was, and still is, to get the rope out and find a tree, and that's going to start a lot more bloodshed in tribal societies. I'm pretty sure there's an entire story in Genesis that consists of a rape from another tribe, into the offer to marry her, that ends with the family agreeing before slaughtering the entire tribe of the rapist in the night. I'd say it was definitely a bad thing.
