It was in response to a commenter who presented the idea that the german lawmakers made the rule to only punish men which is clearly not the case with § 177 StGB. But it is the case in § 183 StGB. The specific law in question is written genderneutral. The standard studying commentary in this matter states that stealthing is the manipulation of any contraceptive action if it is negotiated beforehand that the sexual act will only take place under the condition of the active contraceptive. In no way or form the law or the commentary states that only a man can be the perpetrator.
