If you are so correct, "councilor", please explain why he was not charged? Hmm? And also, if your theory were true, then you would have to wait until you were harmed, because if you cant react on something an intruder might do in the future, be it 2 seconds or 2 minutes, then the reasonable presumption of intent is all for naught . They both already perpetrated serious bodily harm on the victim how was he to know they weren't regrouping to launch another attack on him? He had no way of knowing if the threat was indeed eliminated. The fact of the matter is that he complied with the spirit and intent of the law, and that is why he was not charged after a lengthy investigation.
