Exactly right! If you don't do it now, she will 100% don't later. It may be in 5/10 years but during that time she will be doing nothing but preparing. Financially, emotionally and sexually. You are doing this FOR your daughter. She deserves to see you and eventually your ex wife happy. You're also teaching her perseverance. Doesn't matter if it's an at-fault state. You cannot spy on someone without their knowledge and permission and then use that in a court. Even in one party states where you can record without consent, you cannot spy on someone because there is no consenting party. Therefore inadmissable. There is no way bringing that to the courts attention goes well for you. First, you're saying she is unfit b/c of mental health (first place you will look like the bad guy) but she is good when she is on meds (2nd, you have no proof that if she isn't with you she won't be on them regularly) Next, knowing she will be at poverty level will cause the judge to add alimony. Did the judge or your attorney ask you for something specific? Even so, if it is obtained illegally, it is not admissible in the court. Just like evidence in a criminal case.

Great plan if hers. She make you push the divorce forward, and now she can tell the kid that YOU wanted the divorce and left her with nothing. Now she can go to the court, cry and get what she has in the original deal and more. Plus, the kid is in her side and she gets to have you fund her new single lifestyle!
