well- I know when I am doing right or wrong despite what the law says. the law is often at odds with what is right or wrong. what was that famous book - three felonies a day? shits so fucked up that the average person unknowingly commits three felonies a day. no wonder they can indict a ham sandwich because the ham sandwich is probably committing a felony on its own.

Interesting, so intent is hard to prove because people who secretly have intent can find plausible ways to deny intent. In this case, they can destroy the documents by freeing up server space and say, "well none of you assholes can force us to buy additional server space."

I guess I don't understand how you're supposed to foresee whether or not something that is or is not there could be used as evidence for a case that may or may not exist... and then be held accountable if circumstances do arise, as you "should have known" all along.
