As the_ocalhoun said it's tricky. I am no lawyer and not familiar with german laws. But I'd say in a case with no evidence, the credibility of the testimonies of both parties are weighted: Are the testimonies coherent? Are any holes in a story? What are the criminal records of both parties? If I read the newspaper report correctly, the minimum sentence of the crime in question is 5 years (threat with a weapon and rape). The typo edit was because of a typo like "wrong character". :-) However, as English is not my mother tongue I'm still not entirely sure which tense to use ...proving they were lying? <- favourite ...proving they have been lying? <- 2nd favourite ...proving they had been lying?

Agreed. I came up with the question because some weeks ago there was a criminal court case in Berlin, Germany: A guy was accused of threatening a woman with a knife and raping her, though he said it was consensual sex. It went to court and he refused to testimony, as it was about to go "testimony of A vs testimony of B". I've had women call the store i've worked at and say I tried to touch them (thankfully we have cameras in the back room ) Do you or the store you work at present the videotape to these women and then it is off the table? Or do these women go to court, make a testimony under oath and then the surveillance video of the backroom is shown, proving they were lying? I guess it's done in the first way, but the 2nd way would serve justice more, imho. [edit: typo]

Well, to use your analogy with the road: It's more like the guy with the camera is speeding, while there is a pile-up in front. He rather seems to me like someone who would start honking like hell and start a road rage fight. What would you do on a one lane road if there's a farmer on a tractor and vehicles are piling up? I would understand that the guy would be annoyed and disappointed because he has to slow down/stop. But not as angry to call the girl in front 'bitch'. The ride seems to be in a german speaking country. And as a swiss guy I can tell you that we don't have (yet) this let's-make-it-absolutely-idiotproof-safe attitude, because there's something like common sense.
