If I've said it once, I've said it a thousand times. 23 year olds should not be teaching highschool. The ages are just too close together and shit like this will keep happening. I'm not saying any of this is okay, I'm just saying at 23 some people still identify with 16, 17. At 23 you've only been out of highschool yourself a few years. If she wasn't in a teaching position this would probably be completely legal. I know in my state of North Carolina it would be.
