you have the right to differ, but you are dead wrong. mere words do not constitute assault. the example you gave is literally mere words. you need another element which I stated above: not only the words, but the present ability to carry out the conduct. in the US anyway, since guns are in such large supply. and what in gods green earth does gun supply have anything to do with the specific hypothetical you gave? I feel like you might be trolling me based on that logic

the test isnt whether it can appear, the test is whether there is a present ability to conduct the harm. if its not in her hand, or showing at that point, there is no present ability. if she did produce a lit cigarette like you say, then yes, the element would be met. but until that point, assault would not likely prevail

eh, could be argued either way (at least in the states). I think its objectively clear that she did threat bodily harm, but you need more. you need the present ability to actually carry out the harm. so in regards to the cigarette, if she didnt have a lit cigarette in her hand, there wouldnt be any present ability for her to conduct that act, and it wouldnt be considered assault
