You have a really great point. However, the difference would lie in the motivation behind sending your fleshy body bits across the internet highway. Solicited or unsolicited? Solicited assumes trust. Therefore somebody broke the trust and shared the nudes. Receiver is at fault. Unsolicited assumes creepy flasher. Therefore somebody sent their bits without permission. Sender is at fault.

Interesting. Pretty sure knowingly spreading HIV gets you something like 15 years and that's even without death. The only issue though would be that you would have difficulty proving that she was the root cause.
