Eh. For as absurd as her claim was and as clean as my record is... I was frustrated about having to spend so much...

I went to my sister's wedding in another state. While gone, my ex discovered I had filed in secret so she couldn't take the kids from me to her family in a different state. On my return, her and the kids were gone. I figured out what happened, but 2 days later after telling my daughters goodnight on the phone, I was arrested on false "choking" charges (which is a felony, by the way) with a vague story from a time we had sex recently (big mistake). I forked out 15k to a lawyer and the case was dr…

Depends on what your goals are, if you think it could be amicable, if she has a tendency to fly off the handle etc. If she is stable and sane and there's a chance at amicable, I would, though definitely record the convo just in case. The other people she will talk to (fitness and lawyers) will fill her with all sorts of ideas, and you never know what might stick.

Similar problem here, man. My lawyer recommended a time dependent split too, in this case (i.e. if the house didn't sell in 3 months, 55/45, 6 months, 60/40, etc)

You agree to sell, but the devil is in the details. IF This is situation and you are the one on the hook to pay the mortgage, make sure you have the full right to sell when and at whatever price you please. You don't want her not agreeing just so she can continue to live rent free. Or alternatively, make sure she has some skin in the game and is paying part of the mortgage!

This. Lunch with the judge, every time. It makes such a ridiculously big difference (thankfully for me!) It's kind of terrible how influential the relationship is, instead of the facts of the case. I would talk around work and friends, get some opinions about who is good in your area and then don't look back

I don't think I'll ever get married again after my mess

Man, my (33M) marriage (10yrs) ended 2 years before the divorce came along because I refused to leave her while pregnant/with a little baby. I started dating a few months into the divorce because I was SO lonely for SO long and I want positive companionship and a partner. Words don't do justice here... I'm seeing a wonderful, stable, emotionally intelligent woman who makes me feel fulfilled and supported. She knows about my divorce. I think that it's possible to do and not necessarily bad but is…

God damn, please read this thread if you do nothing else. As a victim of false dv claim, you will save yourself jail time and a metric shit load of headache during the divorce by being a little proactive now. Also understand that false DV if believed can get you kicked out of your home with no right to get anything in it. If you're seriously worried.... have a plan...

She took your son from you for 7 weeks. If anything, you need to put up a fight now so that when you get in front of a judge, they see you fighting and rejecting her behavior (read: see that you car, passionately)

You're telling me. I was so desperate for things to work out that I was even willing to plaster a smile on and try to work things amicably. Then she filed to take my kids away permanently. Fuck that

I completely agree. My friends laugh with me about it but then at home alone at night in the dark it blows. The book helps if only to give you a path which offers some semblance of control/understanding We'll get through this man. Just have to keep our heads on straight. 🤜

Just want to double down on the documenting. I missed my opportunity to do that and I just did not appreciate how impactful that documentation could have been

Being here is a start :) Jiu jitsu is an awesome place to look in my opinion. It has a way of weeding out the people you don't want to support you AND it's pretty hard to think about everything going on while someone is trying to choke you out

Man. I feel for you. I also had the false DV charges and emergency protective order lobbed at me. It fucking hurts for about 10 reasons. I'd give you advice but I'm still going through it too man. About all I've been able to figure out is that I need to just keep putting 1 foot in front of the other, stand tall and show up for my kids, demonstrate that I am not the man she says. It's been recommended on here a number of times, but the book below helped me at least take a breath and bolster mysel…

Man, I struggle with the same thing from time to time. I was arrested on false allegations from her and I STILL had that feeling. It's ok to miss her and it's ok to miss the stability and the life you had. I eventually did a few things that really helped - made a list of the top reasons why I wanted the divorce in the first place with specific examples. I made it with a close friend that helped me remember some things. Also made a similar list of things I'm looking forward to being better or get…

+1 for Jiu jitsu. I've been doing it for 11 years (not divorce related) but it helps SO much keeping my head straight as I go through it. You can't think about how awful the situation is while someone is trying to break your arm and at the same time it is SO rewarding when you tap someone out that it can make even the worst day feel like you accomplished something. And as someone else mentioned, it's a primarily male space in a sport that naturally weeds out the d bags whose fragile egos can't h…

For me - I had been working with the attorney for 3 weeks when my STBXW hit me with a false DV charge. After 13 days of no meaningful progress, only talking to the paralegal who constantly said "I'll have to run that by the attorney", and me finding out that I could still have a path to seeing my kids, i dropped her same day. Within 3 hours of finding a new attorney I had a court date for temporary orders. My takeaway: it's important to be reasonable, but you have to expect performance (includin…

It's SO easy for this switch to flip. Protect yourself

I really feel this - I had false DV charges filed which resulted in removing me from the kids and house temporarily. Literally turned my life upside down. I knew my friends and family were great, but holy shit, it's been an endless stream of support. I love them so much and am just now realizing that I don't have to look to a relationship for all the love in my life

Man, this resonates. If you think a false DV charge is on the horizon, I would really suggest to get yourself a recorder and take notes on daily conflicts to play a little defense. It is SO easy as a male to have a lot of pain inflicted on you regardless of the final outcome of the case (emergency protective orders to not see kids, jail, criminal lawyers, etc). All it takes is for her temper to flare one day

Is this a call recorded that actually records both sides of the conversation? What's your experience with it?

I started using it but am still having trouble getting it to record the other end of the conversation. The noise is only me

Texas is a one party state so as long as one party knows a recording is happening, it is legit

Lol, noted. The more she shows her true colors the easier it is to believe this. I just didn't think she had it in her to pull some of the stunts she is pulling

How was it calculated? '21 was a great year for me, this year will be almost 30k less

Oh wow, ok, that's an interesting point because she can definitely work. I'll ask the lawyer to be sure I understand that definition And yes, child support. Thanks

Honestly, that's a perspective I hadn't considered. I still feel responsible for her

I have no intention of giving her extra money, that is for sure. She is still the mother of my kids and I guess to an extent I feel responsible for making sure she is not just thrown to the wolves? No guilt. Just between alimony and child support somehow it seems ill end up on the hook for 59% of my income, which seems high. I'm not sure how successful people have been negotiating something lower

That's pretty close to my situation... she will literally get more than half of my regular income or so it seems. Curious, was variable pay something that was a part of your conversation?
/r/Divorce_Men10/10/22 08:04 AM

That's the number I'm coming up with too for childcare. Curious, I see you said 1 year? I keep seeing/hearing 5. Is this something you successfully negotiated?

Hah! Don't worry he says.... Fiddling with calculators though it almost seemed like her income doesn't impact the number... did all of the tax credits and such she gets come into the discussion? With her income she would have another thousand a month or so

9.5 years, 2 kids. I guess I didn't realize that you could do that. Is the divorce really that negotiable?
/r/Divorce_Men10/10/22 12:32 AM

We were married 9.5 years and have 2 kids, she being stay at home mom. I guess the thought in my head would be this would afford her the opportunity to get an education for a higher paying job? Technically alimony isn't obligatory in tx until 10 years - working with my lawyer to understand that. Do experiences really vary that much state to state?

Really appreciate you posting this, like always it's never a perfect fit, but I can see a lot of the behaviors here - I was falling into the "maybe she means it" after 2 weeks in this phase with no meaningful changes in 2 months after the D word was dropped

Thank you for posting this. Been married for 9.5 years and sleeping separately for 3 months, working on an apartment and towards divorce, I had no idea what love bombing was
