If they are married and/or he is on the birth certificate, then he is the father - legally. She cannot come after him for back child support or anything like that. Mens rea means state of mind, not ill intent. Most crimes do require a state of mind, but it doesn't have to be ill intent.

"Guilty" state of mind might not mean what you think it means. A lot of time "intent" simply means that you intended to take the action you took. For example, if he did indeed "intend" to "bear hug" that woman, then it doesn't matter whether he intended to "assault" her in his mind.

If you read the article, I believe there is a good argument that in this particular case, the mother is the better option out of the two. Despite the father being out of prison and without custody of his kids, he has not gotten off of drugs, or taken the parenting or anger management classes that have been asked of him. I work in family court right now and I can tell you that when a parent (of any gender) won't even go to parent classes to get their kids back, its a bad fucking sign.

Drugs are quite easy to obtain in prison. According to the article the parent's relationship was extremely abusive in both directions, including long-term physical abuse directed at the mother. That is just not true at all. Paternity has to have been established - non-genetic fathers can consent to being on a birth certificate, but thats as far as it goes.

Bullshit all around. 1) I find it difficult to believe that somebody, especially a drunk somebody, could go all ninja rage and knock two people out instantaneously while putting a third in a headlock. 2) You don't get money when you "press charges", you would file a civil suit separately from a criminal case.

I do, too. I definitely think "sit there and take it" is a loaded response option. I didn't take the survey, but my response would have been the "call the police and fight if necessary to defend yourself" answer.
