From the article: He pled guilty to an involuntary manslaughter charge in March, and was sentenced to five years in prison with give years of supervised probation to follow. So the difference is that he pleaded guilty and she didn't. He got 5 years plus "give years of supervised probation" (I think this means he gets the same amount in jail plus probation). She got acquitted and got the same sentence, 5 years plus 5 of probation.

Strawman is when you create a bogus enemy to avoid an argument. The guy was definitely pointing a logic flaw, not creating a strawman. Creating a strawman would be if she said that population as a whole would perish from the diminishing female population in case of war. It's a made up argument that sounds plausible but has n way to be tested or speculated over, so it becomes a device to avoid the topic entirely.
