This seems like pretty sensible advice, thanks. Basically get ready to file and once I’m ready with a plan and draft agreement I can tell her, and if she won’t play ball then get my lawyer to file. That’s probably what will end up happening, for now I’ll focus on getting all my ducks in a row, thanks.

Keeping the peace seems pretty rational in my position. Right now she’s all bark, no bite, but she is pretty unhinged and could escalate things at a moments notice. This seems like a rational response but I’m fully aware that as soon as I have a new bed to put downstairs in my office, that will be seen as separation and likely as an escalation by my wife, who is pretty unhinged. That’s why I want to wait to talk to and retain a lawyer and for there to be a plan in place. Almost there.

Yeah this is why I’m planning to move into the basement when I file. My wife doesn’t want a divorce (even though she constantly threatens to end the marriage during arguments), so once again it’s left to me to do something about it. When I file for divorce I expect her to do everything she can to drag it out, so I need to stay in the house to make sure shit stays on schedule, and so she doesn’t try to pull any parental alienation tactics or other underhanded shit against me.

Consult an attorney. Your home is considered to be the family home because you and your kids lived there, a protection order can absolutely kick her out of there - at least temporarily, while you get your shit together. Yeah she might going for silver bullet, but I highly doubt that she’s going to get a lawyer and file for divorce first. Her whole schtick seems to be that I’ve been “abusing her for years”, meanwhile she is the one who has been abusing me for years. It’s truly unhinged. Wow good for you in pulling that off. I’m preparing to divorce my abusive wife and I want to keep the house for reasons similar to yours; that it’s in the kids school neighbourhood, and she’ll probably hinder and drag out the sale because she doesn’t want the marriage to end, etc. At the end of the day I’d settle for selling and using my share of the proceeds to buy a house in the same area, but that’s a whole different hassle. Guess we’ll see how it plays out.

Yeah that’s part of what I’m worried about moving out. Also that she will just drag out the divorce process and put off selling the house for as long as she can, try to keep me from seeing the kids, etc I’ll definitely be getting a lawyer soon to help deal with this.

Thanks for sharing that. I think that is the most likely path forward for me, is that I retain a lawyer and force proceedings through the court. Our marriage is toxic as hell but she acts like a child and will not sit down to mediation. She refuses to let go.
