A potential ricochet might have greater odds of injuring an innocent bystander than a bullet falling from the air. Not only are warning shots legal but brandishing your weapon is now also legal but only if both are used to ward off the reasonable fear of great bodily harm or death to yourself or another person. A warning shot is definitely a little on the reckless side but it's certainly a better option than some other possible outcomes. If you're not going several times per month, trust me when I tell you that you're not going to hit anything with any sort of accuracy whatsoever, especially in a situation where your adrenaline has you on edge. A pistol at more than a few yards in a real world scenario is rarely accurate enough to hit a barn door. Hitting a nice group at the range means nothing when it comes to a real world scenario. Or fire a warning shot in the air which is also another legal option and often enough to scare a person into submission. by the time an open shot presents itself, you're getting charged with murder not defense. If there was any doubt whatsoever that I would need more than a single shot or may possibly miss my target then no. My next option would be to fire a warning shot into the air which is also 100% legal in my state. If someone were to try and kidnap my child they wouldn't live to tell about it and luckily my state affords me the right to this use of force. Especially in a situation that dangerous.
