the fact that being accused of rape can really fuck someone up regardless of whether or not they are actually prosecuted for it. Do you think it would fuck people up less if the names of the accused were withheld in the same way? That's kind of what I was thinking would have been the best scenario. The idea is that they are going to be rehabilitated... so in general they wouldn't be doing it again. Edit: Also the state knows who it is, so if she does it again they'll figure it out pretty quickly.

Respectfully I disagree with you. Young people do really stupid shit sometimes. There's no sense in trying to ruin her life as well. If rehabilitation is a viable option, that's vengeance, not justice.

Is there any evidence that punishment deters them? Well I don't commit tax fraud - mostly because, even though chances are not huge that I'll get caught, the punishments suck. I know that's anecdotal, but... I feel like it's imaginable.

In tha article they are going on the premise that punishment is supposed to deter forward-looking, rational potential offenders from criminal activity but then they don't really have a way of measuring whether the perpetrators in their study were forward-looking or rational. (or they don't mention it anyway) I could agree with you, that maybe punishment doesn't deter careless or passionate crimes, but I would disagree that this article shows that premeditated crimes are not significantly deterre…

That just means that life inprisonment and death are similarly deterring for the crimes to which they were applied. If you applied the death penalty to false rape accusations you probably would see a significant drop in their frequency.

As far as vengeance is concerned that's fine, but no matter how long you put them away for, the victim isn't going to be much better off. Maybe force the perp to fund the restoration of the victim's mental/phsyical/financial state. Like they would pay for your psychiatrist, lost wages as a result of firing, costs of relocating to new neighborhood or whatever.
