You guys watch too much CSI. Evidence isn't limited to physical evidence such as DNA or finger prints. Witness statements are evidence. They may not be sufficient to prove anything on their own but they are evidence.

I don't get what you are trying to prove here. Is it that women should go out and kill Nazis too? Is it that a war against fascism somehow means that no one else is allowed to fight against it? I didn't say battery, I said assault. Those are two different terms. Assault is not the realization of physical harm, it's the threat of harm. Assault is the apprehension of immediate harmful or offensive contact. In this situation there is plainly no such apprehension as the physical contact (sex) was consensual. I believe the Irons court ruled that the sperm was a gift and thus he could not sue for conversion but that he could sue for intentional infliction of emotional distress. Depending on what jurisdiction the present case is in the Illinois court of appeals decision is probably not binding.

I agree entirely. As to whether or not she should go to jail would depend entirely on the statutory language in whatever jurisdiction this is. What this poor guy needs is a lawyer that can figure out how to make this happen and someway of covering the legal costs.

Well that is just false. When you partake in an activity that creates foreseeable risk, you owe a duty of care to anyone who may be harmed by that. If you don't like that get a vasectomy, but I hate to tell you even people with vasectomies sometimes end up with children and they are responsible for them. There is not much you can do except abstain for the risky activity or attempt to shift the burden to some else after the fact but you are still liable for the consequences of your actions.

I am not sure what "thing" wasn't true. They are his kids. The paternity proves that. It is a fact. The public policy is that people are responsible for their children. Now there has to be ways to resolve this situation without violating that policy (because ultimately it is a good one). Like I mentioned above what if he filed for sole custody and then chose to give the children up for adoption.

He does owe the children. He choose to have sex. No one forced him. Even "safe sex" has a risk of pregnancy. Nothing is 100% effective and he choose to take the risk just like the rest of us. Now just because the odds came up against him (on account of a crazy woman) doesn't mean he gets to walk away. Having a child is a foreseeable risk of his actions. I never said it was tough luck for him. In fact I said there was likely a claim against her and I am willing to bet a judge would want to penalize such behavior. However, regardless of how it came to be it is your child. Are you so heartless that you would say that means nothing? It is obvious that her behavior was despicable but you can't punish the child for that.

Presumably he would have some claim of action against her (maybe conversion?) but as a matter of public policy they are still his kids. As such he owes them child support whether he wanted them or not.
