I was 23 and had 4 beer. I lost 10,000 dollars and my job during all of this. Oh yea and my gf. I was 2 minutes from home and was pulled over for a tail light that went out THAT day. I’m not a piece of shit. I was a 23 year old who learned a life lesson. An expensive one and I don’t drink any drive anymore at all because of how traumatizing it was. Burden is on the state to prove guilt and not blowing is NOT an admission of guilt in my state. Prosecutor tried the same logic in my case and my attorney argued burden shifting. Basically the state was saying I was hiding my BAC by not blowing but its not my job to prove my innocence rather its the states job to prove my guilt.
