Check and double check with your lawyer ASAP. The premarital ownership can be argued and easily proven, but that 40k loan is probaby going to work against you, as that's marital funds. That could potentially stink things up, because now you've comingled assets. Whatever you do, don't spend any of that money until you have a definitive answer. In fact, don't touch it even after you think you have an answer. Judges frown ferociously on men that try to hide or undervalue or dissipate assets, no mat…

Sadly, I believe that you are a true 'unicorn'. Most of us got the whole "what's mine is mine, and half of yours is mine" deal.... And many of us had to fight for custody, or deal with parental alienation. I'm glad to see that some bitches NOT be cray-cray!!!

Definitely have to agree with the first part-- sure, there's a few factors at work, but once she sees you having fun and being happy, "amicable" disappears. More importantly, whatever you do, keep it quiet and DO NOT involve the kids. I fucked that up and paid a heavy price for it.

Sold the house to pay off all the credit card debt she built up, she was living in the house while I paid for everything, and her really cry was that I was saving money, because maintenence and child support would be more than I was currently paying. Shocker!! She was off by like $800, and after the divorce was finalized but before the house was sold-- she dragged it out for far too long-- she had to PAY ME the difference! That, plus all the lawyer fees... half of my retirement funds... in the e…

Depends on where you're at... but if you were the primary stay at home caregiver, you can probably argue for support, in addition to 50% of any and all marital assets. More importantly... 50% shared custody! Been there, done that.... be prepared to die on that hill!! Nothing else really matters in the end!

About 50 combined, mine was better and billed higher. But because I made 5-6 times more than her, her lawyer petitioned to have me pay her expenses, let her stay in the house while I'm still paying it, let me keep ALL the debt, AND she also wanted support. I'm sure it was her pushing the buttons, lawyers don't care as long as they get paid, and if their client wants to be a complete psycho bitch, oh well. In the end, her lawyer got $10k right off the top of the proceeds from the same off the hou…

The funniest, and saddest part, is other than 31 years (only 23), this is almost word for word my own story. I ran a $2k a month deficit, paying the mortgage on the house for her and the kids, plus my rental house. It all worked out in the end, with $50k going to lawyers.... Like everyone else has said, get a lawyer and cover your ass. We tried the friendly route, and a mediator... but the ex was on a crusade to bury me and make my life miserable. After already poisoning the kids against me. The…

"Didn't want to fleece me"??? Safe to say that your ex is potentially from a different planet. No human woman in a divorce situation could say those words with a straight face. Mine is basically working full time for the first time in over a decade, and taking in a whopping $40k. Divorce situation is essentially she wants 60% of our marital assets and retirement accounts, 30% of the marital debt. And today, she tried to talk me into keeping the house and renting back to her at the same price as …

If you play your cards right and do a little planning, I'm willing to bet there's a whole bunch of us willing to join you on a leg of your journey and/or put you up for a night. I'm in the western burbs of Chicago.

Best advice I got this whole time, from a guy that's been divorced 3 times... Just remember, the woman you're divorcing is NOT the same woman you fell in love with when you got married. Mid 50s here myself, and it still sucks. She's fighting for everything she can try to get, or thinks that she deserves or is owed, pushing for more than 50/50, as well as refusing to pay any of the marital debt, even though she hasn't had a full time job in decades, and spent all of her own money on her shit, cha…

It's a trap!!! My STBX said the same thing... we can divorce amicably and coparent and not fight about anything and remain friends and all those nice friendly things.... lasted about a month or so, and then her head spins around and her skull splits open and the demon emerges...

Divorce won't affect your security clearance, but a felony charge might, depending on your clearance level. Key word here is "charge" and not arrest or conviction. Just being charged with a felony can be a clearance issue, conviction may in some cases bar you from a clearance. And, as others have already pointed out, there's no such thing as an amicable divorce. You got like maybe a 1 in 500 chance of that. Once you start trying to split assets, the amicable just poof!!! disappears. I started of…

I would take 10 years older and 50lbs heavier in exchange for saving $25k, ditching the BPD psycho ex, increased peace of mind, peace and quiet, less stress, solid relationships with the kids without her toxicity poisoning and alienating them, better mental health, and over all less bullshit to deal with. Don't get me wrong, nothing wrong with being younger and skinnier, wish you both all the best.

My STBX actually suggested a 6 year legal separation until our youngest turns 18. Similar situation, I earn all the $$, pay all, ALL the bills and expenses, health insurance, etc etc. Not a f%$@king chance!! And I had already moved out and I'm STILL paying for everything while the lawyers bicker back and forth. I can't wait for this to all be over!

Thanks for the comnentary... just finished up first mediation session, temporary custody and parenting plan being hammered out. Kids are poisoned and alienated against me thanks to the STBXW, but I'm trying really hard to hold onto the promise of a better and brighter future.

Rule #2.... Repeat Rule #1. Do not pass Go, do not collect $200. Seriously.... tried the collaborative approach... she went full psycho bitch, totally unreasonable. Hired a damn good lawyer, but the court required mediation to agree on custody. That failed, because she insisted that every other weekend and occasional weeknight dinner visits would be in the best interest of the child. So enter the Guardian Ad Litem, currently in progress...

This. This right here. If you doubt your lawyer's advice, please ask another lawyer for their opinion. Do not fuck around and find out with the TRO.

I'll tell you what everyone else told me... 50/50 is THE hill to die on. The rest of it isn't important... you'll get over it. You can buy another house, replace the shit you had to sell, whatever. But missing out on the times with the kids, you can't get that back later. I'm on a similar path, trying to cooperatively get to that 50/50 agreement. My lawyers are great and passionate about dad's rights and 50/50. If she gets half of everything I have and everything I owned and what not.... equitab…

I have a friend that divorced her husband a few years ago. She lived upstairs, he lived downstairs. They actually had a masking tape dividing line in the refrigerator. They were both strange ducks in the first place, so this was almost actually normal for them.

IL is a 50/50 state. File now, and your credit card debt and car loan are also split between you, more or less. You can possibly fast track it all if you can prove you're separated, even living in the same house... as long as finances and food (I kid you not) are separate. It all sucks either way., unfortunately. Mediation is the way to go, if you can both agree to everything and play nice. I'm in the same boat.... I've had some lawyer consults, and I have 1 lawyer waiting for a retainer if or w…

Get a copy of the book "Divorce Poison " by Dr. Richard Warshak. It helped me see west was going on a lot more clearly. My STBXW actually....well, supposedly.... read the copy I gave to her. While not anywhere near as severe as your situation, she was always consciously or subconsciously saying or doing things around or in front of our girls. Let's call it accidental alienation.... little comments, snippets of overheard adult conversations, etc etc... my girls always wanted to side with their mo…
