Roe was never a law, it was a ruling based on a theory of law that was not defined anywhere in the Constitution or actual law. This is why even the original Justices on the case specifically admonished lawmakers to codify the result as it would not stand a direct challenge on merit in front of the same court, and they proceeded to do no such thing for 50 years.
