My understanding is any punch directed towards the back of the head. Some might say intend goes into consideration when it comes to that. If you're going to file a formal complaint then you better be damn sure of what you heard. They take that stuff seriously. And it's not just what he said, is how she portrayed the entire exchange. You can pause the video and read it yourself at 1:47. I don't know the details so I have no idea how bad she buried herself in deceit before they charged her with filing a false statement.
