Also, married men who are thinking about working harder to try to get a promotion and a raise might not fully appreciate the consequences. Single men who are considering marriage should see the full range of divorce outcomes before making that decision. My own divorce was sort of similar. However, my marriage was a lot shorter.

I think recent past earnings are a pretty good guide as to earnings capacity unless there is there is a strong reason to believe that the person is not going to be able to find a similar job. When dealing with someone who is out of work, the judge can only estimate the person's earnings capacity and this sentence seems to suggest that, at least in the case of Giunta v. OK, what YellowFever46 was saying about the guy getting imputed to $250,000 even after earning $75,000 for two years didn't seem right to me. So, assuming income of $250,000 three years ago, and then $75,000 for two years, that works out to an average of $133,333 (with a gap between jobs, there could also be a period of zero income).
