You stated it's not a criminal matter, which is patently false. 30% of states have laws regarding herpes. Perhaps you misspoke and intended to say that it is, in fact, illegal to have sex with someone without telling them about your STIs but you are unlikely to get prosecuted.

I'm not sure there is much you can do unless you can prove that you didn't have herpes prior to your relationship with her. Herpes is very prevalent, isn't part of a full STI screening, and most people don't know they have it. Herpes isn't reportable to the CDC or most health departments either.
