I'm only saying that it is not outside the bounds of reason that an employer might actually be a sexist and discriminate against a woman based solely on her gender. Just like there are people who hate blacks or Asians or pretty much any group.

You can use their sources too. edit: It should also be noted that although the evidence points towards the wage gap being much less of a problem than it is made out to be, there are almost certainly isolated areas of the country where women may be discriminated against. Although I don't have any sources, I would assume that anecdotal evidence exists somewhere that someone could use to "prove their point."

Joking aside though, the only thing I could think of is that (a) nobody has challenged this yet, or (b) The institution does not receive federal aid and is thus not beholden to the Equal Protection Clause (as that only applies to government or entities receiving government funds.)
