They do have them and they use them, but people can refuse. They have small portable ones and they have large ones at police stations. In order to use the device you need to be trained on it so you are considered an expert, otherwise you're creditability would be destroyed in court. Not all officers are trained on breathalyzers.

You can but you will be charged with additional crimes and lose your license due to implied consent. Driving is a privilege and not a right so the government can take it away if you do not comply.

Bc you have rights in this country. The person can refuse the breathalyzer or blood test. The law needs a court order if they refuse. Edit: They do have them and they use them, but people can refuse.
