Wow, AP sounds like a real shit. I'm also in NY. What my lawyer told me was that in order for adultery to come into play, you have to have really rock solid proof, AND evidence that the affair was "egregious" in some way - for example, the spouse spending a lot of marital assets on the relationship with the AP.

I won like that too, couldn't even believe it. I got all of the equity we built over 16 years - every last penny.
