It wouldn't be murder, it'd be negligent homicide. Maybe the issue here is that the terminology for different varieties of sexual misconduct isn't very well developed.

Let’s just keep it to right and wrong. Okay, I respect that. If you know that a sober individual would likely not consent if they were sober, you shouldn’t have sex with them if they are drunk. Period. It’s just wrong. If you have any reason to believe that the reason they are consenting is due to their intoxication, it’s still rape, regardless of whether it can stand up in court. I understand you interpretation of the video, but I'm not sure that I agree. From my perspective, the guy just seemed disappointed. It's obviously difficult to tell either way from a short video, but I think that's indicative of an issue with these things where any judgement will be inherently highly subjective. I feel like the two qualifiers that you have there probably wouldn't apply to most people who are having intoxicated sex. I think that neither of those questions would even occur to someone intoxicated enough to be considered unable to consent. Maybe we are thinking about different alcohol levels here.
