Good Lord. I explained WHY it’s done that way at the point of litigation. Lawyers have to protect their clients. The better path is to work with your lawyer to resolve things before it gets to one party filing before the other. If the couple cant cooperate in parenting their own children, don’t blame the lawyers.

Imagine you file asking for “joint.” Your spouse files asking for “sole.” You then realize that you can either capitulate and give up any custody, or fight for “sole.” You cannot have a situation where one parent has “sole” custody and the other has joint custody. So, realizing that your prayer for “joint” will no longer work, and not wanting to give up ALL decision-making, you change your prayer from “joint” to “sole.” If your case goes to trial it’ll be a disaster.

In most US jurisdictions, “custody” determinations have nothing to do with terminating parental rights — it’s about decision-making power. Big decisions — which school will the child go to, which Dr. Will the child see, etc. It’s not unethical to zealously represent my client and it doesn’t cost a penny more. Illinois divorce lawyer, here. We no longer use the word “custody” in Illinois Family Law matters. You’re a shoe-in for “joint decision-making.” The “parenting schedule,” on the other hand, will depend on things like work schedules, school schedules, extra-curricular activities, housing, etc. Illinois presumes the maximum involvement of both parents serves the child’s best interest. Kids CAN take the stand. Lawyers usually don't have to go that far, however. If an issue like this becomes sticky, a judge will usually appoint a Guardian ad Litem or a "child's representative" who will speak with the child and then relay the salient facts. Where does OP say his former spouse made more than he does? A former spouse may choose between their own SS benefit or 50% of their former spouse’s benefit. This is bad advice, depending on your jurisdiction. In Illinois, extra-curricular activities come first (up to a point) unless there are some extenuating circumstances that might warrant changing the schedule altogether. Talk with your lawyer about how to handle it. This issue is usually not adress in statutes but is finely hashed out over decades of common law.

Pay for a consultation with a few different lawyers. I'm in Chicago. I charge $400 for a typical consult -- other lawyer around here charge $100 - $500. You'll get a good explanation of the law, an overall strategy for your case, and the lawyer will tell you what to expect in the litigation and as a result.
