Correct me if I'm wrong, laws change a lot between US states, and even more between the US and Australia, but wouldn't charges be dropped if the prosecution decided not to pursue them as part of a plea deal? I'm not a fan of the slave wages they pay inmates however I do believe that in lieu of a working salary, private prisons shouldn't exist and the profits should be funneled into creating a functioning member of society.
