| 1 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth..."Further, from http://www.nytimes.com/2011/07/06/nyregion/still-a-case-for-trying-strauss-kahn.html?_r=1 Prosecutors do not have to abandon criminal cases simply over problems with witnesses’ backgrounds, said Bruce Green, a law professor at Fordham and an authority on legal ethics. “If you think the case is still tryable, that the jury will understand that although the person has not been truthful about things in the past, you can proceed,” Mr. Green said. With a jury trial, 12 people would deci… | /r/MensRights | 07/07/11 04:34 PM |
| 1 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth...""[i]t has never been the rule in this country - I hope it never will be - that suspected criminal offences must automatically be the subject of prosecution" Here it is not simply a case of suspicion. The prosecution has 3 key pieces of evidence - DNA, physical injury and victim testimony. The bare minimum to do is file charges for trial. Or at least attempt a plea deal. Most of the reasons provided to dismiss the charge wouldn't even be admissible in court as evidence, particularly the IRS stuff… | /r/MensRights | 06/07/11 08:39 PM |
| 1 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth..."The burden of proof does not lie with the defense, moron Thank you for calling me a moron. That was profoundly helpful. Once the prosecution demonstrates DNA evidence, physical genital injuries and testimony by the victim it is sufficient to obtain a rape conviction. At this point the defense has to counter and show that at least one of the three items is unreliable. Of the 3 pieces of evidence DNA, medical injury report and testimony they go after the testimony by attacking the reliability of t… | /r/MensRights | 06/07/11 05:41 AM |
| 0 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth..."IIRC this was a case of forced oral sex. Why would there be evidence that sex occurred, and why would the victim have genital injuries if only oral sex occurred? He may have assaulted her there before the rape. I have no more details about that. Normally her word would be good enough, but we have good reason not to trust her word They found that she lied on her asylum application to obtain residency. Beyond that they haven't found a single speck of dirt on her, via her employer or anything. Beli… | /r/MensRights | 06/07/11 02:43 AM |
| 1 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth..."You're right, any time there is a vaginal injury it must be rape. No, of course not. I am discussing the prosecution's behavior. It is up to the defense to show that injury is not enough to demonstrate rape. But once you have gotten this far the accuse is in a really hard pickle. But instead, in this case the prosecution actually took over the job of the defense attorney. This is absurd. The political maneuvering in this case is blatantly obvious. There is way too much physical evidence to avoid… | /r/MensRights | 06/07/11 12:51 AM |
| -1 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth..."really? I was unaware a jury had found him guilty through a court case yet. Didn't you get the news? There will be no case or jury trial - The charges will be dropped. No trial, no jury, no conviction. IT IS THE PROSECUTORS JOB TO UPHOLD THE PUBLIC INTEREST No, you don't understand this. It is the prosecutor's job to secure a conviction. It is the public defenders/ defense attorneys job to secure a dismissal. The net effect is to uphold public interest. Here the prosecutor has clearly taken over… | /r/MensRights | 06/07/11 12:40 AM |
| -4 | Prosecutors to drop charges against Strauss-Kahn - "She is not to be believed in anything that comes out of her mouth..."If anyone has been following the case closely, this is an open-and-shut case of rape. DNA evidence shows sex occurred and the victim had genital injuries. Typically, going after the character of the victim is the job of the defense attorneys and not that of the prosecution. The prosecution went out of their way to investigate the victim and leaking all kinds of information about the victim that is meaningless like There were deposits of thousands of dollars into the victims bank account by diffe… | /r/MensRights | 05/07/11 05:11 PM |
