2	consent while drunk Typically when alcohol is used as a mitigating factor in criminal law, it's used to show that something wasn't premeditated (ok that's not the only reason, but the point is mitigating factors don't mean that no crime was committed). So basically, it can be used to say that someone isn't guilty of a particular crime (if part of the requirement for the crime is premeditation), but it doesn't mean that they are completely innocent of any crime.
