If the law worked as intended, there would be no need to prove that she was consenting. The burden would be on the prosecution to prove beyond a reasonable doubt that she did not consent. Unfortunately, the law is written in such a way that the defense cannot challenge the motives or credibility of the witness, which is typically the only evidence in a case like this.

I am too lazy to look it up, but I remember some shifty things with adoptions in Utah without a father's consent. I believe it involved women taking their kids to Utah to put them up for adoption, which was legal under Utah law. The men had no way to get their kids back.
