In the example of Wells Fargo, the incentives developed by management encouraged fraudulent behaviour. That's why there is some responsibility on them. There is no way that the employer could have known that their employee would do something so far outside of normal. I personally would NEVER in a million years think I need to explicitly tell an employee not to refuse to serve someone because they are a man.
