This is like when an unarmed person tries attacking a cop. "You had a gun and he was unarmed, why would you have felt threatened?" The gun does not offer protection if using it is wrong.

I actually think it's a good amount of time. The question we should ask is "are they likely to do it again when they are released?" I'd say 5 years would probably be a really good deterant from false accusations in the future. I believe in an element of punishment to the sentence, but I believe the primary function of the sentence should be to protect society from the criminal. We have enough real rape victims in the Army that need the attention of investigators. This woman didn't just hurt the soldier she accused, she also hurt every actual rape victim. I'm always happy to see false accusations get punished severely. I hope the article is correct and it's just jail, not prison. As poetic as it would be, I wouldn't want her to suffer the crime that the claimed to be a victim of.

They need to be used in conjunction with a trained and experienced operator who reads a lot more than just the equipment. The equipment gives them another metric to add to the information they're basing their judgement on. Even then, they're not perfect.

I was on board with this, but eventually it was made a little clear to me what her production company is. The cop messed up only by not explaining that signing the ticket wasn't an admission of guilt, or if he did, it was before the clip started. He didn't make it clear that her options were to sign the ticket or go to jail. Although we both know what she would have done had he said that, considering she fled once she was placed under arrest.

I believe that's how it is in most states. They need your acknowledgement that you understand the citation, but most importantly, the officer needs proof that the citation was in fact given. Without a signature, there is no proof (although today many officers wear body cams) that the ticket was actually given that tells them that they have an obligation to appear in court.

I love that the officer got her to admit to intentionally assaulting him. In court, the debate over whether or not those kicks were assault or not could have gone on for hours. The "yeah I tried to kick you" coming from her mouth really seals that one.

The problem is, he admits that he did run the red light and lied to a judge under oath. Had he gotten a 'guilty' verdict, it likely could have been a lot worse.

Let's just take a moment and address the fact that under Alabama state law, this is a $25 fine. It's a citation, which is like a traffic ticket, so it's not an arrest-able offense. The owner of the stadium never asked her to leave, so she's not trespassing. At most, that cop's got "failure to comply with a lawful order," which is a really tricky one in courts. He could of course ask for an ID, which in the context would be a lawful order, and would make it an arrest-able offense.

That's actually really depressing. My grandmother is at that stage, too. She's really sweet to everyone, though, and is still extremely mentally sharp and physically capable. That part just makes it worse, honestly.
