This is a perfect example of why spouses should not choose the high conflict option. They like that the breadwinner “pays” their lawyers fees. They don’t realize, they would have been much better off agreeing to 50/50 and taking half of the $75k instead of wasting it on lawyers

You don’t know people’s situations, the spouse and AP could live states away. Like I stated earlier, “emotional” affairs are only emotional because they haven’t had the opportunity to make it physical. It’s still an affair and should be treated as such. Don’t ever fall for the “It was only an emotional affair” line.

That’s pretty petty, especially if you have kids. If there’s kids involved, she should definitely be entitled to keep the same last name as the kids. If there’s no kids involved and you’re that petty, you can try to get it added to the divorce decree.

Thats a good point, the reason I haven’t done anything so far is because Texas recognizes at fault divorces. And if a spouse has an extramarital affair and uses marital funds to facilitate the affair, they can significantly reduce or deny spousal support.

Another point after reading the whole post, you can have a lawyer draft a rent to own lease for her. Make it so the rent is the exact amount as the mortgage and increases accordingly. Then write in provisions that the sole right to the property reverts back to you if she falls to pay.

There are only 3 options: -She keeps the house, buys you out AND refinances your name off -You keep the house, pay her half the equity to buy her out -You sell the house and split the proceeds Absolutely do not file a quit claim deed to give her the house while the mortgage is in your name. If you are on the mortgage, you are not only held responsible if she doesn’t pay, but it also makes it significantly harder for you to buy another house.
