Sexual assualt and rape are not the same thing under Indian law. IPC Section 375, even after the 2013 reform, states marital rape is not a crime, at least when the husband and wife are living together. But it is a crime when the wife is living separately. Section 498A only makes it a prosecutable domestic violence case.
