False rape accusations are not punished to prevent a precedent for retaliating against women who were actually raped. This doesn't make sense. First of all they are, many women are arrested every year for committing false rape accusations. Second, why does categorizing true or false accusations make people retaliate against actual victims? The other accusations against Nungesser were not independent of one another and were not considered assault by the victims before Emma spoke to them. This is why after 7 months of college level investigation, the college didn't find any evidence of him being guilty of rape.

Don't most of the reports on sexual harassment in the media involve reporting on other people's accusations, rather than the media making accusations themselves? Along the lines of "Six women have come forward, accusing Harvey Weinstein of sexual misconduct". Certainly that's not libel anywhere, is it? That wouldn't matter. Telling the media about something about someone else that isn't true in the UK would not be legal, according to the article. Again, there they have no 1st amendment.

But Aziz admitted that it was true, even with the caveat that he didn't realize it at the time. If the outlet had contacted him ahead of publication, he probably would have admitted it then, too. So that's not a good example. But Aziz is categorized as being non consensual by other media outlets. Nothing about the encounter as legally not consensual.
