There's no clear picture of either of their state of mind. A lot of this is bordering on irrelevancy though, if she didn't want it, vocalized that to him, and he didn't stop, it doesn't matter more than a hill of beans if she tried to escape or fight him off. The same would be relevant in a case of woman on man or man on man rape.

Jury nullification comes to mind, or when the person is still charged but is written off as time served. I can't really see something like that coming to light in a rape case though, i mean, its a little more clear cut (after the conviction, of course. The circumstances leading up to if someone is actually guilty or not is a whole other can of worms)
